| Program operator | Qtrials Inc, doing business as FACIL; patient-facing service name: Facil Health |
| Trademark | FACIL® — U.S. Trademark Registration No. 7,518,759 (owned by Qtrials Inc) |
These terms apply only to the Facil Health SMS messaging program. They do not replace the general patient registration documents, the HIPAA Notice of Privacy Practices, or other applicable healthcare policies.
1. Program description
Facil Health sends non-marketing text messages to patients who have chosen to receive them. Communications may include appointments and scheduling, confirmations, reminders, rescheduling, laboratory appointments, ultrasound imaging appointments, physical therapy appointments, pharmacy administrative coordination, office follow-up and non-clinical customer assistance. Messages may be automated or sent by authorized office staff. This program is not intended for advertising or unsolicited promotional messages.
2. How patients enroll (opt-in)
Patients may voluntarily enroll by signing a written SMS authorization during the in-person registration process at a Facil Health medical office. The consent request should be clearly identified as an SMS choice separate from authorizations for voice calls or release of medical records. Signing up for SMS is not a condition of receiving medical treatment or purchasing services. A copy of the authorization is retained in the patient registration record.
Patients must provide a mobile number that belongs to them or that they are authorized to use. They should notify the practice if the number changes. SMS consent applies to this Facil Health messaging program and is not consent to unrelated campaigns or third-party marketing.
3. Message frequency and charges
Message frequency varies depending on each patient’s appointments, requested services, and communications with the office. Messages may recur. Message and data rates may apply according to the patient’s mobile carrier plan. Facil Health does not charge a separate subscription fee for enrolling in this SMS program.
4. How to opt out
Reply STOP to a text from the Facil Health messaging number to stop future messages from this program. Following processing of the request, a single confirmation text may be sent. Patients may also disable SMS authorization through their Facil Health patient portal or contact the office. Opt-out requests will be honored and should be synchronized across the patient portal and messaging system. To resume messages after opting out, patients must complete a valid new enrollment method.
5. HELP and support
Reply HELP to a Facil Health text for support instructions. Patients may also call 305-560-6040 for assistance with this SMS program, or visit https://www.qtrials.com for general company information.
6. Safety and limitations of SMS
Standard text messaging is not an appropriate channel for emergencies. Do not use SMS to report urgent symptoms, request emergency care, or transmit sensitive clinical details. In an emergency, call 911. The program is designed for scheduling and administrative matters, not for delivery of diagnoses, laboratory results, prescription details, or other sensitive medical information. Patients should use the secure patient portal or contact the office for sensitive matters.
Wireless delivery is not guaranteed. Network issues, device settings, carrier filtering, incorrect numbers or other conditions can delay or prevent messages. Mobile carriers are not liable for delayed or undelivered messages.
7. Privacy of mobile information and consent
Qtrials Inc / Facil Health uses the mobile telephone number and documented SMS consent to manage patient communications and message preferences. We do not sell or share mobile phone numbers, SMS opt-in data, or SMS consent with third parties or affiliates for their own marketing or promotional purposes. Messaging service providers may process limited information only as needed to deliver and administer this program under appropriate service arrangements. The medical practice handles protected health information in accordance with applicable privacy requirements and its separate HIPAA Notice of Privacy Practices.
8. Changes and contact
Facil Health may update these terms to reflect changes in the SMS program, applicable requirements, or service providers. Material program changes will be communicated through an appropriate channel. Patients may ask for a current copy of these terms by contacting the office.
